The following describes our practices for collecting, using, and disclosing personal information, including without limitation on the Pollin websites we link to this policy and any other collections of personal information that we link to this Privacy Policy (collectively, the “Website”). This Privacy Policy also applies to our practices for collecting, using, and disclosing personal information on Pollin’s mobile application [name].
Please note that this Privacy Policy and Terms of Use do not apply to connected fertility services provided by Pollin Fertility or any other services or functionality that includes the collection, use, storage or disclosure of personal health information.
By using the Website, or by choosing to submit personal information to Pollin, you consent to all of the terms of this Privacy Policy. If you do not agree with any terms of this Privacy Policy, please do not use the Website or submit any personal information to Pollin.
Please note that when you access any external links from the Website (including any Pollin subsidiary websites), they may have different privacy policies specific to those third-party websites. We are not responsible for such third-party websites, and we encourage you to read all privacy policies posted on the third-party websites that you visit.
This Privacy Policy applies to any personal information we collect or receive about you, from you or any other source. “Personal information” as used in this Privacy Policy refers to any information that identifies, relates to, describes, or is reasonably capable of being associated with a particular individual and that is recorded in any form (such as your name, your phone number, your postal and email address and your payment information), as further defined in the Personal Information Protection and Electronic Documents Act (“PIPEDA”) or other applicable provincial legislation. It may also include technical information such as your IP address, browser settings and device ID, but only when this information can identify you as an individual. Please note that personal information excludes information that is anonymized and cannot be associated with an identifiable individual and aggregate information which represents compiled data from a group of individuals who can no longer be individually identified.
The personal information Pollin collects directly from you depends on how you use our Website, Mobile App and services. Pollin generally collects personal information when you register an account with us, browse a Website, download our Mobile App or interact with us directly. The personal information we collect directly from you includes:
Personal identifiers. Pollin may collect personal information like name, telephone number, e-mail address, date of birth, home or business and mailing address when you access certain areas of the Pollin Websites that require registration for certain services, or if you require more information about those services or send us questions, comments, suggestions or complaints.
Payment information. If you decide to purchase our products or services, our third-party services providers may need to collect certain additional information, like your credit or debit card number and expiration date, bank routing information and account number.
Device Information. When you connect to our services using a custom application (apps), we may collect device-specific information through our website or other technologies such as your device model, operating system, unique device identifiers, and mobile network information. We may associate your unique device identifier or phone number with information that you may have used to register for certain services or purchase products. Server logs that are maintained by us or by our third-party service providers may contain information about the services that you have used, and your device-specific information. We may also maintain digital communication logs that track information like your phone number, calling-party number, forwarding numbers, time and date of calls, duration of calls, and SMS routing information. We may use your device’s IP address or MAC address to track device-event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
Authentication. If you register for an account with Pollin, you are required to authenticate your access. Depending on your mobile device and your choices this may include using features such as FaceId, SMS messaging, or biometrics.
Specialized Information. We may collect and store information (including personal information) locally on your device through our website or other technologies such as browser web storage (including HTML 5), application data caches, cookies or other similar technologies. Certain services may include a unique application number in connection with the installation of apps. This number and information, including, without limitation, operating system type and app version number may be sent to our service providers when you install, update or uninstall apps. We may also collect and process information about your general geographic location, such as your postal code, IP address, domain name, your browser type, pages you view, links you click, the length of time you visit or use the service, and how you use the service.
Changing your communication preferences. You may be offered the opportunity to subscribe to and receive additional information about our services and offerings. You can change your choices by contacting our customer service e-mail at privacy@pollinfertility.com. Each commercial e-mail that we send to you will offer you the opportunity to opt-out of continuing to receive such messages. It may take some time to process your opt-out requests. In some instances, we may have already shared your information with one of our authorized service providers before you changed your information preferences. Please note that even if you have indicated your choice not to receive commercial messages from us, we may still communicate with you in connection with a service, in accordance with applicable law (for example, to send you important service information or certain transactional messages).
Changing your browser settings on your device. We use technology to enhance your experience and present you with offers, including personalized advertising. Through technologies such as cookies, our Websites and Platform recognize you when you use or return to them and can provide you with a seamless experience. You may be able to set your browser settings to use our Website without cookies functionality. Please note that if you block cookies, some services functions and Websites may be unavailable and we will not be able to present personally-tailored content and advertisements to you. Pollin may use personal information to operate our business and provide our services, to respond to your inquires or complaints, to process job applications, to improve our Websites and services, for marketing and advertising purposes, and for legal, safety, and security purposes, including to protect our rights, property and safety and those of our employees, customers and the public and to detect and prevent fraud. For example, we use this information to analyze the use and delivery of our services, such as determining whether containers have been overfilled, or damaged, and to enforce our terms of service with you.
We use cookies and related tools for capturing Usage Information (collectively “Tracking Technologies”) for the following purposes:
Strictly Necessary. We may use cookies or other Tracking Technologies that we consider are strictly necessary to allow you to use and access our Website, including cookies required to prevent fraudulent activity and improve security.

Pollin may use personal information to create anonymized or aggregated data which does not identify you or any other individual. We reserve the right to provide non-personal identifying information, such as aggregate data, to third parties. We may also use non-personal aggregate information to improve our Websites, Mobile App, or for any other purpose we deem appropriate. For example, our Internet Service providers may report to us that there were a particular number of visitors to a certain area of our Websites or Mobile App or that a certain number of businesses or a certain number of individuals completed our registration forms in particular areas of our Websites or Mobile App. Such information may also be used to analyze the effectiveness of our business and advertising models.
We may use personal information to understand and assess your interests and changing needs with a view to improving our products and services and developing new ones, as well as to evaluate potential improvements or other modifications to the functionality of our websites. For instance, we may use third-party web analytics services, such as Google Analytics, to help us analyze how visitors use our websites. When required by law, we will use anonymized information for these purposes. We may use your personal information to provide you with personalized content and services, such as tailoring our products and services, our digital experience and offerings, and deciding which offers or promotions to show you on our digital channels.

At times Pollin may use the services of independent companies to provide certain services to you, including, to entities affiliated to Pollin, website hosting services, credit card processing, product promotions, order processing and shipping services, and visitor surveys. Pollin may disclose your personal information with these service providers as appropriate under our business models, including to assist us in carrying out the purposes described in this Privacy Policy, or as otherwise disclosed to you, it being understood that they will only be permitted to use the information as part of the performance of their work for us or when the disclosure of the information is required by law and that such third parties will have appropriate privacy standards in place. Other than our service providers, we do not share personally identifiable information with non-related third parties without your consent, except to the extent necessary to complete your request for products and services offered through the Pollin Website.
Pollin may also use or disclose your personal information as is necessary to: (a) comply with a subpoena or court order; (b) cooperate with law enforcement or other government agencies; (c) establish or exercise our legal rights; (d) protect the property or safety of our company and employees, contractors, vendors, suppliers, the public and customers; € assert or defend against legal claims; (f) help with internal and external investigations; (g) to complete a business transaction or in the context of a prospective transaction, such as a transfer of assets or shares or merger, in accordance with applicable legal requirements, or (g) as otherwise required by law or permitted by law. We may disclose your information in connection with the sale or merger of a Pollin company or any transaction that involves the sale or assignment of some or all of our assets.
Pollin has implemented physical, electronic, and procedural security measures to assist with safeguarding your personal information in our possession, and to help protect against unauthorized access and disclosure. Only our authorized personnel and those of our service providers who perform legitimate business functions for Pollin are authorized to access your personal information.
Notwithstanding our efforts, the Internet has inherent security risks. Pollin cannot promise, and you should not expect, that your personal information, personal searches, and other communications will always remain secure. You should take care with regard to how you handle and disclose your personal information or any username or password that you are required to use to access services on our Websites or Mobile App.
Some or all of the personal information we collect may be stored, accessed or processed on servers located outside your jurisdiction of residence (for example, outside your province or outside Canada, such as in the United States, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.
By providing us with personal information, you understand and expressly agree that we may transfer it outside of Canada or your jurisdiction of residence. If you do not agree to the transfer of your personal information outside of Canada, do not provide us with personal information.
Pollin’s Website is open to all. However, Pollin’s content is not directed toward children who are under the age of 14. We do not knowingly collect personal information from children or minors. If Pollin becomes aware that a child has provided us with personal information without parental consent, that information will be deleted from our databases. If you have questions about personal information that may have been submitted by your child, please contact us as indicated in the Privacy Support Contact section below.
You may request access to your personal information and to request a correction to it if you believe it is inaccurate, incomplete or no longer up to date, subject to limited exceptions set out in applicable laws.

Please note that we will only retain your personal information for as long as reasonably necessary for the above purposes or as required by law. Once no longer required, your personal information will be securely destroyed or anonymized, in compliance with applicable laws.
Pollin may update this privacy policy from time to time, and you should take the time to review it each time that you visit one of our Websites or Mobile App. The privacy policy is current as of the date which appears at the top of this page. By using one of our Websites- or Mobile App, or providing us with personal information after we update this privacy policy, you agree to this privacy policy as revised. These terms and conditions of use (these “Terms and Conditions”) constitute a legal agreement and are entered into by and between you and Pollin Inc (“Pollin,” “we,” “us,” “our”). The following terms and conditions, together with our Privacy Policy govern your access to and use of the Pollin Mobile Application (the “Pollin Mobile App”) and the Website (the “Website”).
BY USING THE POLLIN MOBILE APP AND/OR THE WEBSITE YOU ACCEPT AND AGREE TO BE BOUND BY AND COMPLY WITH THESE TERMS AND CONDITIONS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR THE PRIVACY POLICY, YOU MUST NOT ACCESS OR USE THE POLLIN MOBILE APP AND/OR THE WEBSITE.
By using the Pollin App and/or the Website, you represent and warrant that you are 18 years of age or older. If you are under 18 you must fully review these Terms and Conditions with your parent or legal guardian prior to using the Pollin Mobile App and/or the Website.
We reserve the right in our sole and absolute discretion to revise and update these terms and conditions from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the Pollin Mobile App and/or the Website.
To improve the Pollin Mobile App, we may add or remove features, functionalities, and the support of certain devices and platforms. Our services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our services, including certain features and the support for certain devices and platforms. Where feasible, we will endeavour to provide you with prior notice of any such discontinuation. Events beyond our control (such as acts of God, flood, fire, earthquake, explosion, war, terrorism, civil unrest, labour actions, national or regional emergencies, or any similar event) may temporarily or permanently impact our ability to provide you with access to the Pollin Mobile App.
The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized collection, use, and disclosure. The safety and security of your information also depends on you. Users are responsible for maintaining strong mobile device security protection and for taking other reasonable precautions necessary to prevent others from gaining access to your Pollin Mobile App and/or Website accounts.
Any username, password, authentication link or any other piece of information chosen by you, or provided to you as part of our security procedures, should be unique, must be treated as confidential, and you must not disclose it to any other person or entity.
You are prohibited from attempting to circumvent, and from violating, the security of the Pollin Mobile App and/or the Website, including, without limitation by: (a) accessing content and data that is not intended for you; (b) attempting to breach or breaching the security and/or authentication measures which are not authorized, including by attempting to reverse engineer code or reviewing or modifying application binaries; (c) restricting, disrupting or disabling service to users, hosts, servers, or networks; (d) illicitly reproducing TCP/IP packet headers; (e) disrupting network services and otherwise disrupting our ability to monitor the Pollin Mobile App and/or the Website; (f) using any robot, spider, or other automatic device, process, or means to access the Pollin Mobile App and/or Website for any purpose, including monitoring or copying any of the material on the Pollin Mobile App and/or the Website; (g) introducing any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful; (h) attacking the Pollin Mobile App and/or the Website or any related site or service via a denial-of-service attack, distributed denial-of-service attack, flooding, mailbombing, or crashing; and (i) otherwise attempting to interfere with the proper working of the Pollin Mobile App and/or the Website.
You are prohibited from using the Pollin Mobile App and/or the Website for any illegal or unauthorized purpose, and you must not use the Pollin Mobile App and/or Website to abuse, harass, threaten, impersonate, or intimidate any other Pollin Mobile App and/or Website user.
You understand and agree that the Pollin Mobile App and/or the Website and their entire contents, features, and functionality, including, but not limited to, all information, software, code, text, and displays, are owned by Pollin, its licensors, or other providers of such material and are protected in all forms by intellectual property laws and rights including without limitation, copyright, trademark, patent, trade secret, and other proprietary rights.
Pollin’s name, logos, product and service names, designs, images, and slogans are trademarks of Pollin or its affiliates or licensors. You must not use such marks without the prior written permission of Pollin. Other names, logos, product and service names, designs, images, and slogans mentioned, or which appear on the Pollin Mobile App and/or the Website are the trademarks of their respective owners. Use of any such property, except as expressly authorized, shall constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject the infringer to legal action.
You may only use the Pollin Mobile App and/or the Website for your personal and non-commercial use. You shall not directly or indirectly reproduce, compile for an internal database, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Pollin Mobile App and/or the Website, in any form or medium whatsoever.
Any use of the Pollin Mobile App and/or the Website not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may infringe or violate copyright, trademark, and other intellectual property laws.
We disclaim and are not responsible or legally liable to you or any third party for any claims arising from or related to the accuracy or truthfulness of any of your responses or the provision of any personal information.
The Pollin Website and Pollin Mobile App are intended to provide users with general information for educational and informational purposes. Reliance on any information provided by us, our employees, others appearing on Website or Mobile Application is solely at your own risk. Other parties retain their full responsibility for their statements and actions.
You may not use the Website or Pollin Mobile App in any way to engage in threats, coercion, intimidation, or other similar acts. You may not use the Website or the Pollin Mobile App to engage in any activities that might be illegal within Canada.
The Website requires you to provide personal information, such as your name, birth date, and email address. The Pollin Mobile App requires you to provide a photo and certain other personal information, such as your name, birth date, and email address. If you register for fertility testing services delivered by an authorized third-party health service provider, additional information, for example, health provider information, symptoms, and health history may be required. By using the Pollin Mobile App and/or the Website, you agree to our collection, use, and disclosure of such personal information in accordance with these Terms and Conditions and our Privacy Policy. You hereby grant us a world-wide, royalty-free, perpetual, irrevocable, non-exclusive license to use, collect, and disclose such personal information strictly in accordance with these Terms and Conditions and the Privacy Policy.
The owner of the Pollin Mobile App and/or the Website is based in Ontario, Canada. We provide this Pollin Mobile App for use only by persons located in Canada and the United States and the Website for use only by persons located in Canada. The Pollin Mobile App and Website are not intended for use in any jurisdiction where its use is not permitted. If you access the Pollin Mobile App from outside Canada or the United States and/or the Website from outside Canada, you do so at your own risk and you are responsible for compliance with local laws of your jurisdiction.
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE POLLIN MOBILE APP AND/OR WEBSITE IS AT YOUR OWN RISK. THE POLLIN MOBILE APP AND THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
POLLIN MAKES NO WARRANTY, REPRESENTATION, OR ENDORSEMENT WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, SUITABILITY, ACCURACY, CURRENCY, OR AVAILABILITY OF THE POLLIN MOBILE APP AND/OR THE WEBSITE OR THEIR CONTENTS. YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR USE OF THE POLLIN MOBILE APP AND/OR THE WEBSITE.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
Pollin reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Website, or any portion of the Website, for any reason; (2) to modify or change the Website, or any portion of the Website, and any applicable policies or terms; and (3) to interrupt the operation of the Website, or any portion of the Website, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
EXCEPT WHERE SUCH EXCLUSIONS ARE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCE WILL POLLIN OR ANY OF ITS PARENT, SUBSIDIARIES, AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING ANY DAMAGES OR LOSS FROM, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, WHETHER CAUSED, DIRECTLY OR INDIRECTLY, BY TORT, PROFESSIONAL NEGLIGENCE, BREACH OF CONTRACT, BREACH OF PRIVACY, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OR RELIANCE ON, POLLIN MOBILE APP AND/OR THE WEBSITE OR THE PROVISION OF TESTING SERVICES PROVIDED BY POLLIN. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE POLLIN MOBILE APP AND/OR THE WEBSITE IS TO STOP USING THE POLLIN MOBILE APP AND/OR THE WEBSITE AND ANY RELATED SERVICE.
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Pollin, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to your breach of these Terms and Conditions; your use of the Pollin Mobile App and/or the Website other than as expressly authorized in these Terms and Conditions or breach of privacy or security involving your personal information.
The Pollin Mobile App and/or the Website and these Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision.
All disputes and questions whatsoever arising from or in connection with your use of the Pollin Mobile App, the Website and/or these Terms and Conditions or the Privacy Policy shall be resolved by arbitration. Such arbitration shall be conducted by a single arbitrator. The arbitrator shall be appointed by agreement between the parties or, in default of such agreement, such arbitrator shall be appointed by a Judge of the Superior Court of Justice sitting in Toronto, Ontario, upon the application of any of the parties and such judge shall be entitled to act as such arbitrator, if he or she so desires. The arbitration shall be held in the City of Toronto, Ontario. The procedure to be followed shall be agreed to by the parties or, in default of such agreement, determined by the arbitrator. The arbitration shall proceed in accordance with the provisions of the Arbitration Act, 1991 (Ontario). The arbitrator shall have the power to proceed with the arbitration and to deliver his or her award notwithstanding the default by any party in respect of any procedural order made by the arbitrator. The decision arrived at by the arbitrator shall be final and binding subject to a right of appeal to a court of competent jurisdiction on matters of law only. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms and Conditions operates, or may be construed, as a waiver thereof. No single or partial exercise of any right, remedy, power, or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.
If any term or provision of these Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.
These Terms and Conditions and our Privacy Policy constitute the sole and entire agreement between you and Pollin regarding the Pollin Mobile App and/or the Website and any related service and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
